MotoCare Terms & Conditions

Welcome to MotoCare. These Terms & Conditions ("Terms", "Terms and Conditions") govern your access to and use of the MotoCare mobile application and related services.

By downloading, accessing, registering for, or using MotoCare, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the application.

1. About MotoCare

MotoCare is a vehicle management application designed to help users organize and manage vehicle-related information, including:

• Vehicle information

• Maintenance and service records

• Fuel records

• Vehicle-related expenses

• Odometer readings

• Maintenance schedules

• Custom reminders

• Vehicle-related statistics

• Map and location-related features

MotoCare is intended as a management and record-keeping tool and does not replace professional automotive, mechanical, financial, legal, or safety advice.

2. Eligibility

You may use MotoCare only if you are legally capable of entering into these Terms under the applicable laws of your jurisdiction.

By using MotoCare, you represent that:

• The information you provide is accurate and not intentionally misleading

• You have the legal right to use the information and vehicle data you submit

• You will use the application only for lawful purposes

• You will comply with these Terms and applicable laws

3. Account Registration

Certain MotoCare features may require you to create an account.

You are responsible for:

• Maintaining the confidentiality of your account credentials

• All activities performed through your account

MotoCare allows users to enter and manage vehicle-related information.

You are responsible for ensuring that the information you enter is accurate and up to date.

This may include:

• Maintenance records

• Service records

• Fuel records

• Expense records

• Service costs

• Maintenance schedules

• Reminder information

MotoCare does not independently verify the accuracy of information entered by users.

You acknowledge that incorrect or incomplete information may result in inaccurate calculations, reminders, statistics, or other application outputs.

5. Maintenance Reminders and Notifications

MotoCare may provide maintenance reminders, service reminders, notifications, and other vehicle-related alerts based on information entered by the user.

These reminders are provided for convenience only.

MotoCare does not guarantee that:

• Every reminder will be delivered

• Notifications will always be delivered on time

• Reminder calculations will always be accurate

• A reminder will prevent vehicle damage or mechanical failure

Users remain solely responsible for monitoring their vehicles and ensuring that required maintenance, servicing, inspections, registration, insurance, and other obligations are completed on time.

6. Vehicle Maintenance and Safety Disclaimer

MotoCare is not a mechanic, automotive repair service, vehicle manufacturer, or professional automotive advisor.

Information, calculations, reminders, statistics, or suggestions provided through MotoCare should not be considered professional mechanical or safety advice.

Users should consult a qualified mechanic, vehicle manufacturer, authorized service center, or other appropriate professional for vehicle maintenance, repair, inspection, and safety decisions.

MotoCare is not responsible for vehicle damage, mechanical failure, accidents, injuries, losses, or expenses resulting from reliance on information provided through the application.

7. Fuel and Expense Tracking

MotoCare may allow users to record fuel purchases, fuel consumption, expenses, and related information.

Any calculations, statistics, averages, or summaries generated by MotoCare are based on information provided by the user and may not always reflect actual vehicle performance or financial costs.

MotoCare does not guarantee the accuracy of financial calculations where incorrect, incomplete, or inconsistent information has been entered.

8. Location and Map Features

Certain MotoCare features may use location or map services.

Where required, users must grant appropriate device permissions to use such features.

Location-based information may depend on third-party map and location providers and may be affected by:

• GPS accuracy

• Network availability

• Device settings

• Third-party service availability

• Environmental conditions

MotoCare does not guarantee that location information or map data will always be accurate, complete, or available.

Payments may be processed through third-party payment providers or supported payment platforms.

By purchasing a paid service, you agree to the applicable payment provider's terms and conditions.

are owned by or licensed to MotoCare and/or its applicable owners and licensors and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms or applicable law, you may not copy, reproduce, modify, distribute, sell, license, or create derivative works from MotoCare or its proprietary content without prior written authorization.

13. User Content and Data

You retain responsibility for the information and content you submit to MotoCare.

By submitting information to MotoCare, you grant us the limited rights necessary to store, process, display, and use that information to provide and improve the services.

We do not claim ownership of your personal vehicle records merely because you store them through MotoCare.

Our collection and use of personal information is governed by the MotoCare Privacy Policy.

14. Service Availability

We aim to keep MotoCare available and reliable, but we do not guarantee that the application will always be:

• Available

• Uninterrupted

• Error-free

• Secure

• Free from technical problems

• Compatible with every device or operating system

MotoCare may occasionally be unavailable due to:

• Maintenance

• Updates

• Technical problems

• Network failures

• Server issues

• Third-party service failures

• Security incidents

• Circumstances beyond our reasonable control

We may modify, suspend, or discontinue any feature or part of MotoCare at any time where reasonably necessary.

We may suspend, restrict, or terminate your access to MotoCare if:

You may stop using MotoCare at any time.

18. Disclaimer of Warranties

To the maximum extent permitted by applicable law, MotoCare is provided on an "as is" and "as available" basis.

We do not guarantee that:

• The application will always operate without interruption

• Information provided through the application will always be complete or accurate

• Reminders or notifications will always be delivered

• Calculations or statistics will always be error-free

• Third-party services will always remain available

• The application will be free from all bugs or security vulnerabilities

Your use of MotoCare is at your own discretion and risk.

19. Limitation of Liability

To the maximum extent permitted by applicable law, MotoCare and its owners, developers, employees, partners, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the application.

This may include, without limitation:

• Vehicle damage

• Mechanical failures

• Accidents

• Loss of data

• Loss of revenue or business

• Financial losses

• Loss of profits

• Service interruptions

• Reliance on reminders, calculations, or application information

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

To the extent permitted by applicable law, you agree to indemnify and hold harmless MotoCare, its owners, developers, employees, partners, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from:

• Your misuse of MotoCare

• Your violation of these Terms

• Your violation of applicable laws

• Information or content you submit to the application

• Your unauthorized use of another person's information or account

Your use of MotoCare is also governed by our Privacy Policy, which explains how we collect, use, store, protect, and process personal information.

The updated Terms will become effective on the date stated at the beginning of the revised Terms.

Your continued use of MotoCare after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

23. Governing Law

These Terms shall be interpreted and governed by the applicable laws of Bangladesh, unless otherwise required by applicable law.

Any dispute arising from or relating to these Terms or your use of MotoCare shall be subject to the jurisdiction of the competent courts of Bangladesh, unless otherwise required by applicable law.

24. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary, and the remaining provisions shall continue to remain in full force and effect.

25. Entire Agreement

These Terms, together with the MotoCare Privacy Policy and any additional terms applicable to specific features or services, constitute the entire agreement between you and MotoCare regarding your use of the application, unless otherwise agreed in writing.
